Responsibility of malaga.bike
The sale of the products published on the website malaga.bike is managed by Forever Cycling S.L. (ESB93467587).
malaga.bike is obliged to provide complete and truthful information about the condition of each product and to answer any related queries.
malaga.bike is obliged to deliver the product in full working condition, being exempt from any responsibility in relation to possible breakages or defects of the product produced after the delivery of the product to the customer and that have been caused directly by the customer due to a bad use of the product.
malaga.bike does not assume responsibility for errors or damages caused by an inefficient and bad faith use of the service by the customer, or by the falsity of the data entered by the customer at the time of the formalization of the order.
Responsibility of the customer
The customer is obliged to provide all necessary and true information in order to proceed with the sale or enquiry.
It is the customer’s responsibility to make sure that the model of bicycle he intends to buy is what he needs and to check on the bicycle manufacturer’s website that the size is correct.
Test drive
The test ride is done as a regular 1 day rental. The customer has to sign the contract, leave the deposit and accept all the bike2malaga rental conditions listed in the terms and conditions on that page (link). In case the customer, after the test ride, decides to buy the bike he/she has tested, the rental price is deducted from the final price of the product.
Payments
You can pay in cash, by credit card or by bank transfer. In case of bank transfer, the transaction costs for non-EU countries are to be paid by the buyer. Payment is considered to have been made when the full amount reaches the malaga.bike account.
Delivery of the bicycle
We deliver the bicycles personally to our physical shop or send them to you, depending on prior agreement.
Collection of used bicycles in the shop: we deliver them assembled, checked and adjusted. When picking up the bicycle, the customer confirms that the bicycle is delivered to him in a perfect state for use and that the components of the bicycle correspond to the product description.
Shipping of used bicycles: by agreement.
Collection of new bicycles from the shop: assembled and adjusted, or according to agreement.
Delivery of new bicycles: in the manufacturer’s original condition.

The recipient is responsible for checking the delivery note and verifying that the contents of the delivery note correspond to the goods received on delivery. The recipient is responsible for checking that the package is in good condition when receiving it, indicating on the delivery note any damage to the packaging or any other incident.
If the customer considers that the product is not in good condition, he/she must always record this in writing on the carrier’s delivery note, clearly explaining the incident and taking photographs that reflect the problem (general phrases such as ‘pending inspection’ are not valid).
Once the procedure has been carried out and a problem has been detected, inform malaga.bike (bike@malaga.bike) of this non-conformity within 24 hours of receiving it, attaching a copy of the delivery note where the commentary of the detected incident is reflected, as well as the photographs that support the non-conformity.
Failure to comply with the above steps, malaga.bike assumes no responsibility for shipping damage.
Return
According to the law, the customer has the right to cancel the purchase within 14 calendar days after delivery of the product. In case of exercising this right, the buyer must deliver the product to the malaga.bike workshop in perfect condition, for validation of its condition by the company. malaga.bike will not accept returns when there are clear signs of use by the buyer or when the product is returned with damage or modifications that it did not have at the time it was delivered to the buyer.
The return of new bicycles will only be accepted if they are unused. malaga.bike does not accept returns of new bicycles with marks of use.
The return of used bicycles will be accepted in the same condition as at the time of delivery. We do not accept the return of bicycles with new marks of use, signs of misuse or technical modifications made outside our facilities.
In case of shipments, the shipping costs in case of return are borne by the buyer, unless the product is defective – in this case the shipping costs are borne by malaga.bike.
In both cases, the amount is refunded after the bicycle arrives at our facilities and after the bicycle has been checked by our mechanics. If the bicycle meets the above conditions, the full amount paid by the buyer will be refunded. In case of transfer, the transaction costs for non-EU countries are to be paid by the buyer. If the bicycle has been purchased or collected in the physical establishment, instead of the refund of the amount paid, the company will offer its customers the option of exchanging the purchase made for an equal or lower amount; or to receive a voucher with a duration of six months for the value previously paid, as long as the product is in good condition and has not been damaged or modified.
The bicycle must be returned in a well-sealed and properly protected box to limit the risk of damage during the return transport. The best option is to send it back in its original box. If the bicycle is received by us in defective packaging, or the bicycle received scratches/damage due to defective packaging, we will not accept the return, and we will return the bicycle to you at your expense.
In order to exercise the right of withdrawal and return the product, the buyer must notify malaga.bike in writing, at the following address (bike@malaga.bike), within 14 days of receipt of the product.
Warranty conditions
All bicycles leave our premises inspected and in perfect condition. For used bicycles, we replace all worn parts during the inspection process whenever the bicycle needs it. In addition, we carry out a complete lubrication and adjustment before sale.
malaga.bike offers to all its customers a guarantee in accordance with the current legislation in the terms established for second-hand products, for a period of 1 year from the delivery of the bicycle, and a guarantee in accordance with the current legislation in the terms established for new products, for a period of 3 years from the delivery of the bicycle.
Components such as suspension forks, shock absorbers and telescopic seatposts have a reduced warranty of 6 months subject to the need for periodic maintenance required by the manufacturer within that period for new products and 3 months for second-hand products. The warranty will not be valid if the faults or damage to the bicycle are due to incorrect use of the product, knocks or falls, or lack of maintenance of the product. The warranty is non-transferable and will only cover the purchaser of the product at malaga.bike. The warranty shall consist of the repair free of charge of any fault, defect or defective component, provided that such defects do not arise from the misuse of the bicycle or its parts. The material to be replaced as part of the warranty will be exchanged for the same or the same range from another manufacturer whenever possible. malaga.bike reserves the right to mount a lower range material when it is discontinued, out of stock or out of stock in the usual distributors. Not covered under warranty are defects or paint marks and the replacement of wear items such as pads, tyres, chains, chainrings, chainwheels, sprockets, spokes, wheel centring and bearings, among others.
malaga.bike will not pay any guarantee for a repair carried out outside its facilities, as long as it has not been previously approved by the company. Similarly, if a bicycle has been disassembled or manipulated by an external workshop prior to the review by malaga.bike, the company will not be responsible for the warranty due to the impossibility of validating whether the incident could be the result of this process.
All actions related to the warranty will be managed through the Customer Service Department, who will inform our customers in detail how to proceed for the management of the same.
